OBLIGATIONS RELATED TO CONTRACT CONTRACTS OR WORK OR ADMINISTRATION CONTRACT

 

 

The current legislation, which regulates relations with contracting companies or self-employed workers in the case of assignment of works to be carried out at our offices, poses certain obligations:

  • verification, technical and professional suitability of contractors or self-employed workers in relation to the works to be awarded in the contract or by means of a work or administration contract;
  • detailed information on the specific risks existing in the environment in which contractors and self-employed workers are destined to operate and on the prevention and emergency measures taken;
  • cooperation and coordination for the implementation of the prevention and protection measures against risks at work subject to the contract through the elaboration of a single risk assessment document, to be attached to the contract or work contract, which indicates the measures taken to eliminate interference.

In order to comply with the above, operating procedures have been established for the correct management of relations with contracting companies and / or with self-employed workers who perform any type of work within our office.

 

PROCEDURES FOR THE APPLICATION OF ART. 26 Legislative Decree 81/08

The procedures differ according to whether the works present interference risks or not:

Risky contact between the client’s staff and that of the contractor or between the staff of different companies operating in the same company headquarters:

  • resulting from overlapping of multiple activities carried out by operators of different contractors;
  • placed in the client’s workplace by the contractor’s work;
  • existing in the client’s workplace, where the contractor is expected to operate, additional to those specific to the contractor’s own business;
  • arising from particular methods of execution explicitly requested by the client (which involve additional dangers compared to those specific to the contracted activity).

 

CONTRACT CONTRACT OR WORK CONTRACT WITHOUT INTERFERENCE

 

In case of assignment of the works to contractors or to self-employed workers, at INFN offices, as well as within the entire production cycle WHICH DO NOT PROVIDE THE PRESENCE OF INTERFERENCES: 

At the time of the offer request, provide contractors or self-employed workers with detailed information on the specific risks existing in the environment in which they are intended to operate, on the prevention and emergency measures adopted:  dossier

Together with the offer, or in any case before the order, the administration acquires the information required by law from the company or self-employed worker:dossier

CONTRACT CONTRACT OR WORK CONTRACT WITH INTERFERENCES

In case of assignment of the works to contractors or to self-employed workers, at INFN offices, as well as within the entire production cycle:

1   At the time of the offer request, provide contractors or self-employed workers:

 

  • detailed information on the specific risks existing in the environment in which they are intended to operate, on the prevention and emergency measures adopted:  dossier
  • the single risk assessment document to be developed in collaboration with the RSPP: DUVRI
  • calculate, in collaboration with the RSPP, the safety costs necessary to eliminate interference;

2  acquire from the Administration the declaration that provides for the presence of interference

3  carry out the inspection with the successful company and jointly with the RSPP, review and update the DUVRI, if necessary: DUVRI and Inspection
